The question was raised whether the IORP II Directive, as incorporated in the Greek legal order with the Law 4680/2020, also applies to the converted Occupational Insurance Funds of article 36 of Law 4052/2012.

The new L. 4808/2021 published in the Government Gazette on 19.06.2021 brings a lot of changes in the individual and collective labour law, regarding leaves, protection of employees, dismissal of employees, teleworking, right to strike etc.

Πρόσφατα ο νομοθέτης συμμορφώθηκε μερικώς προς τις αποφάσεις του Ελεγκτικού Συνεδρίου και του ΣτΕ που είχαν κρίνει αντισυνταγματικές τις περικοπές συντάξεων συνταξιούχων του δημοσίου και του ιδιωτικού τομέα αντίστοιχα. Πράγματι, τα άρθρα 33 και 34 του Ν. 4734/2020, όπως εξειδικεύονται αντίστοιχα από τις υπ’αριθμ. Φ.11321/37311/1610 και Φ.11321/35005/1528 κοινές υπουργικές αποφάσεις (ΚΥΑ) των Υπουργών Οικονομικών και Εργασίας και Κοινωνικών Υποθέσεων, προβλέπουν την επιστροφή των αναδρομικών ποσών συντάξεων που αντιστοιχούν στις επελθούσες μειώσεις των κύριων συντάξεων για το χρονικό διάστημα από 11.06.2015 έως και 12.05.2016 και επιβλήθηκαν στους συνταξιούχους του δημόσιου και του ιδιωτικού τομέα κατ’εφαρμογή των Νόμων 4051/2012 και 4093/2012. Η σχετική καταβολή των επιστρεπτέων από τον e-ΕΦΚΑ ποσών θα γίνει άτοκα, με εφάπαξ καταβολή μέχρι την 31η .12.2020.
