The intention of the Greek government, derived also under the pressure of troika, to terminate the suspension of the real estate auctions, which had been established by law since 2009 and is extended, under certain conditions, each year, has sparked heated discussions lately. The decision for suspending the auctions was introduced as a legislative act, in an attempt of the State to regulate the private financial market in favor of a broader public interest.

The legislative framework concerning the pricing of in-patent drugs in Greece can be summarized in the conflict between two dominant tendencies. On the one hand, because of the fact that medicines constitute a social good, associated with the citizens’ health (the obligation of the Sate to take measures for the protection of the citizens’ health is explicitly mentioned at article 21 paragraph 3 of the Constitution), there has always been a tendency to compress the cost of the pharmaceutical expenditures as well as for it to be covered by the insurance funds. On the other hand, this policy cannot extend to extremity, because it may lead to the infringement of the pharmaceutical companies’ as well as other operators’ (that are involved in the commercialization of medicines) right to the economic freedom (article 5 paragraph 1 of the Constitution).

Law 4174/2013 instituted Code of Tax Procedure, which includes specific provisions regarding the administrative procedures of defining, imposing and collecting tax revenue, as well as regarding the administrative penalties imposed, due to the tax payer’s non-compliance with the legislation into force, concerning that revenue.
